These Terms of Use ("Terms") govern your access to and use of the website, lead and application forms, client portal, and related services (collectively, the "Services") provided by Lendigator ("Lendigator," "we," "us," or "our"), operating as Lendigator. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
Acceptance of These Terms
By using the Services, submitting a funding request, or otherwise interacting with Lendigator, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy and Disclaimer, which are incorporated by reference. These Terms form a binding agreement between you and Lendigator.
Who May Use the Service
To use the Services, you must:
- Be at least 18 years old (or the age of majority in your jurisdiction).
- Be a business owner or an authorized representative with the authority to act on behalf of the business you are submitting information for.
- Use the Services for legitimate business purposes only — our Services relate to commercial financing, not consumer loans.
By submitting a request, you represent that the information you provide is accurate and that you are authorized to bind the business to these Terms.
What Lendigator Is — and Is Not
Lendigator is a business financing referral service and loan brokerage. We help businesses find and compare commercial financing by connecting them with third-party lenders and funding partners. We are not the lender, and we do not originate, underwrite, or fund the financing ourselves — all financing is subject to the funding provider's underwriting approval.
Where we connect you with third-party lenders or capital partners, the financing relationship — including the loan or financing agreement, rates, fees, and terms — is between you and that provider.
No Guarantee of Approval, Rates, or Terms
Submitting information through the Services does not guarantee that you will be approved for financing or receive any particular amount, rate, or term. Approval is not guaranteed. All financing is subject to underwriting, verification, and the funding provider's criteria. Funding amounts, rates, and terms vary by business profile, financial performance, product, and jurisdiction.
The Application & Funding Process
The Services are informational and facilitative. When you submit a request:
- Your submission is a request to be evaluated — it is not an offer of financing and does not, by itself, create a binding financing commitment.
- You authorize Lendigator to share your information with lending and capital partners to obtain offers on your behalf.
- You authorize Lendigator and its partners to obtain credit and verification information relevant to your request, as described in our Privacy Policy.
- Any offer you receive comes from a funding provider and is subject to that provider's terms, documentation, and final approval.
Your Responsibilities & Accurate Information
You agree to:
- Provide true, accurate, current, and complete information.
- Promptly update information that changes during the process.
- Keep any portal login credentials confidential and notify us of unauthorized use.
- Use the Services only for lawful purposes and in compliance with these Terms.
You are responsible for evaluating any financing offer and deciding whether it is right for your business. We recommend reviewing all terms with your own legal, financial, or accounting advisors before accepting.
Fees & Compensation
Checking your funding options through Lendigator is free, and you are under no obligation to accept any offer.
Lendigator may receive compensation from the lenders and funding partners in our network when a transaction is funded, and/or may charge a fee that is disclosed to you in writing before you accept any offer.
Any fees payable by you will be disclosed to you in writing before you are asked to accept an offer. The rates, fees, and total cost of any financing product are set out in the funding provider's agreement.
Third-Party Lenders, Partners & Content
The Services may involve, reference, or link to third-party lenders, capital partners, and service providers. We do not control and are not responsible for the acts, omissions, products, terms, or content of these third parties. Your dealings with them — including any financing agreement — are solely between you and that third party. Conduct your own due diligence before entering into any agreement.
Intellectual Property
The Services and all related content — including text, graphics, logos, the Lendigator name and wordmark, the Lendigator mascot, design elements, and software — are owned by or licensed to Lendigator and are protected by intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your own internal business purposes. You may not copy, reproduce, modify, distribute, scrape, or create derivative works from our content without our prior written permission.
Acceptable Use
You agree not to:
- Submit false, misleading, or fraudulent information.
- Use the Services for any unlawful, harmful, or unauthorized purpose.
- Attempt to gain unauthorized access to our systems, accounts, or data.
- Interfere with or disrupt the Services or their security.
- Use automated means to scrape, harvest, or collect data from the Services without permission.
- Infringe the rights of Lendigator or any third party.
Electronic Communications & Consent
By using the Services, you consent to receive communications from us electronically, including by email and, where you have opted in, by text message. You agree that electronic records and electronic signatures satisfy any legal requirement that communications be in writing. Marketing communications are subject to the choices described in our Privacy Policy (you can unsubscribe at any time; reply STOP to texts).
Disclaimers
The Services and all content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or secure. The Services are for informational purposes only and do not constitute financial, legal, tax, or investment advice. Limitation of Liability
To the fullest extent permitted by law, Lendigator and its affiliates, officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenue, data, or business opportunities, arising out of or relating to your use of (or inability to use) the Services, even if advised of the possibility of such damages.
To the extent any liability cannot be excluded, our total aggregate liability for all claims relating to the Services is limited to the greater of the amount you paid Lendigator, if any, in the 12 months before the claim, or CAD/USD 100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
Indemnification
You agree to indemnify and hold harmless Lendigator and its affiliates, officers, employees, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any law or third-party right.
Third-Party Links & Services
The Services may contain links to third-party websites or resources. We provide these links for convenience only and do not endorse or assume responsibility for third-party content, products, or practices. Accessing third-party sites is at your own risk and subject to their terms and policies.
Governing Law & Dispute Resolution
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the courts located in Ontario, Canada, unless otherwise required by applicable law.
Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the Services after an update constitutes acceptance of the revised Terms. If you do not agree to the changes, stop using the Services.
Termination
We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or for any other reason in our discretion. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive.
Severability & Entire Agreement
If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force. These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and Lendigator regarding the Services and supersede any prior agreements. Our failure to enforce any right is not a waiver of that right.
